KOCHAM WINO Program Regulations as of September 1, 2025 Conditions of Participation in the “KOCHAM WINO” Loyalty Program
1. Introduction and Definitions
1.1. This document (hereinafter referred to as the “Regulations”) defines the rules of operation of the “KOCHAM WINO” Loyalty Program (hereinafter referred to as the “Loyalty Program,” “Program,” or “Club”) and the conditions of your participation in the Program (the “KOCHAM WINO” Club), including the rules for granting Program participants (Club members) discounts, and for collecting and using Points through successful referrals of the Application and making purchases in accordance with these Regulations.
1.2. Terms used in these Regulations shall have the following meanings, unless the context in which they are used indicates otherwise:
- AMBRA or Organizer – AMBRA BRANDS sp. z o.o., with its registered office in Warsaw, ul. Puławska 336, 02−819 Warsaw, registered in the business register maintained by the District Court for the Capital City of Warsaw, XIII Commercial Division of the National Court Register under KRS number 0000759267, with NIP: 951−23−10−694 and REGON: 142405847, being the organizer of the Loyalty Program.
- Participant Survey – a form submitted by a person joining the Loyalty Program, containing the Participant’s personal data. Completing the Participant Survey electronically shall be equivalent to creating an Account in the Application under the terms described in a separate set of regulations.
- Application – mobile software (available after installation on a terminal device) through which it is possible to join and participate in the Loyalty Program. Detailed rules for using the Application are available in the Application Regulations at: https://centrumwina.pl/wp-content/uploads/2023/07/230704_Regulamin-Aplikacji-KW.pdf. The Application is administered by AMBRA and can be downloaded via Google Play or the App Store.
- Assortment – all products, including wines, other alcoholic beverages, and wine accessories offered by the “Centrum Wina, Distillers Limited” Store or a Partner Store, for which a Program Participant may use collected Points according to the rules of these Regulations.
- KOCHAM WINO Customer Service – electronic customer service center providing information about the rules and offerings of the Loyalty Program via the email address kochamwino@kochamwino.com.pl, providing information on the Participant’s Points Balance, accepting changes to personal data submitted during Program registration, reports of damage, loss or theft of the KOCHAM WINO Card (physical form), and complaints.
- Regular Price – gross product base price, not reduced by any discount (gross retail price).
- KOCHAM WINO Card – a discount card containing an individual number, marked with the Program logo, issued to the Participant to identify a member of the “Kocham Wino” Club (Program Participant). The Card may be issued physically or digitally as a virtual card. Receiving a digital KOCHAM WINO Card requires having an Account in the Application.
- BURGUNDY Card – a KOCHAM WINO Card entitling the Participant to a MAIN Discount of 10% on wines and spirits from the Assortment at Regular Prices.
- SILVER Card – a KOCHAM WINO Card entitling the Participant to a MAIN Discount of 12% on wines and 10% on spirits from the Assortment at Regular Prices. The Silver Card is awarded after completing 6 Visits within 12 months (counted from the date of the first Visit).
- GOLD Card – a KOCHAM WINO Card entitling the Participant to a MAIN Discount of 15% on wines and 10% on spirits from the Assortment at Regular Prices. The Gold Card is awarded after completing 6 Visits within 12 months (counted from the date of the first Visit) and achieving a Participant Turnover of at least 10,000 PLN gross.
- Account – the “Kocham Wino” Account or Participant Account on Winezja.pl.
- “Kocham Wino” Account – an account where data related to participation in the Loyalty Program is stored, including Points assigned to the KOCHAM WINO Card. This includes data collected and stored in AMBRA’s system, including the Participant’s Account in the Application.
- Participant Account on Winezja.pl – an account where, after successful verification, data related to participation in the Loyalty Program and Points assigned to the KOCHAM WINO Card are linked.
- PARTICIPANT TURNOVER – gross amount resulting from purchases made by the Participant, assigned to the Participant’s KOCHAM WINO Card number.
- Receipt – type of fiscal document settling Points used for a selected product from the Assortment.
- Product – wine or spirit available in the Store, excluding brands or products listed at https://centrumwina.pl/asortyment-lub-marka-nie-bioraca-udzialu-w-programie-kochamwino/, for which Points are awarded.
- Points – accounting units in the Program awarded to Participants for purchasing certain Products or successfully referring the Application as defined in the Regulations. Participants may Redeem Points for Assortment.
- MAIN Discount – a benefit consisting of reducing the Regular Price of wines and spirits available in the Store, granted to KOCHAM WINO Card holders according to the Regulations. The MAIN Discount cannot be combined with special offers or other promotions during or outside the Program.
- Points Balance – the number of active and unused Points accumulated by the Participant through Program participation or special campaigns, as defined in separate regulations.
- Store – the “Centrum Wina, Distillers Limited” Store or a Partner Store.
- “Centrum Wina, Distillers Limited” Store – a stationary retail store operated by AMBRA, authorized to sell alcoholic beverages for off-premises consumption. The list of participating Stores is Annex 1 to these Regulations.
- Partner Store – a stationary retail store, authorized to sell alcoholic beverages for off-premises consumption, cooperating with AMBRA under separate agreements, including “Skład Wina i Whisky” in Pruszków, ul. Gomulińskiego 8, operated by Premium Service sp. z o.o., Warsaw, KRS: 0000349548. The list of Partner Stores is Annex 2 to these Regulations.
- Participant or Club Member – a Loyalty Program participant who has joined the Program under these Regulations and received a KOCHAM WINO Card.
- Winezja.pl – the website www.winezja.pl, administered by Soare sekt a.s., Videnska 101/119, 619 00 Brno, registered under B 6096. Terms of use and available services are at: https://winezja.pl/media/wysiwyg/Uploads/Regulamin-Witryny-Winezja.pdf.
- Visit – making in-store purchases at a “Centrum Wina, Distillers Limited” or Partner Store. For Partner Stores, a prior reservation via Winezja.pl is required. All purchases on the same day count as a single Visit. Purchases in the “Centrum Wina, Distillers Limited” Store and a Partner Store on the same day count as separate Visits.
- Points Redemption – using accumulated Points for selected Assortment items, reducing the product Regular Price to a minimum of 1.00 PLN gross, as a one-time discount per transaction.
1.3. AMBRA is a reward promisor within the meaning of Articles 919 et seq. of the Civil Code.
1.4. The Program is organized on the territory of the Republic of Poland.
1.5. The Program aims to promote AMBRA products and brand, as well as entities participating in the Program.
1.6. The Program is not intended to restrict access to the market for other entities offering products similar to those in the Loyalty Program (“Other Entities”). Participation conditions and Points collection are not dependent on Participants performing or refraining from activities related to Other Entities’ products, during or after the Program.
1.7. AMBRA reserves the right to make changes under the terms described in the Regulations. AMBRA may amend the Regulations provided that Participants’ acquired rights are not violated. Unless stated otherwise, changes will be announced three days in advance in the Application or via email sent to the Participant’s registered email address.
2. KOCHAM WINO Program
2.1. The Loyalty Program is organized and managed by AMBRA. The Program operates in Poland, in the “Centrum Wina, Distillers Limited” Stores, in the Partner Store “Skład Wina i Whisky,” as well as through the Application and the Winezja.pl portal.
2.2. Within the Loyalty Program, Participants collect Points in connection with making purchases of Products in the Store (including after prior reservation via the Winezja.pl portal) or as a result of successfully referring the Application. The number of Points depends on the type of rewarded action or the value of the purchased item. Participants also receive a KOCHAM WINO Card, which entitles them to a specified MAIN Discount on selected Assortment products available in the Stores. During the Program, the Organizer may run special campaigns or additional promotions dedicated to Participants. The Organizer will inform Participants each time about such campaigns and their rules.
2.3. Persons employed by AMBRA under an employment contract or civil law agreements, including service contracts or contracts for specific work, may not participate in the Program during its duration. This provision also applies to persons employed in the Stores or by the entity administering the Winezja.pl platform.
3. Participants
3.1. Only a natural person who is at least 18 years old, resides in the territory of the Republic of Poland, has full legal capacity, properly completes the Participant Survey, and receives a KOCHAM WINO Card (electronic or physical) may be a Participant (Club Member) of the Program.
3.2. Completing the Participant Survey requires providing the following data:
- For a paper Participant Survey:
a) phone number (to receive a verification code necessary to log into the Application or use Winezja.pl portal functionalities);
b) email address;
c) first and last name;
d) date of birth;
e) postal code. - For an electronic Participant Survey (completed in the Application or via a dedicated subpage in a domain belonging to AMBRA, to which the person joining the Program will be redirected from Winezja.pl):
a) phone number (to receive a verification code);
b) email address;
c) first and last name;
d) date of birth;
e) postal code.
Regardless of the form of the Participant Survey, the Participant declares that they are of legal age, have read the Regulations, and accept their content. These declarations are made by checking the appropriate checkbox.
3.3. A person joining the Program receives an individually assigned KOCHAM WINO Card number:
- after correctly completing and signing the paper Participant Survey at the “Centrum Wina, Distillers Limited” Store and acceptance of the document by an authorized Store employee; or
- after AMBRA receives a correctly completed electronic Participant Survey.
3.4. The KOCHAM WINO Card contains a unique number. The Participant is considered the holder entitled to use the Card.
3.5. AMBRA is not obliged to inform the Participant about an incorrectly or incompletely completed Participant Survey. However, AMBRA will attempt to contact the Participant to confirm or complete the data.
3.6. If AMBRA identifies incomplete, illegible, or incorrectly entered data in the Participant Survey, or has doubts regarding the truthfulness of the data, AMBRA has the right to temporarily block the KOCHAM WINO Card until the Survey is completed according to the Regulations or the doubts are sufficiently clarified.
3.7. A single registration in the Program is sufficient. Multiple registrations using the same data will result in the loss of the PARTICIPANT’S TURNOVER and Points on the duplicate (second) Account, and the deactivation of the KOCHAM WINO Card associated with that Account.
3.8. Data provided by the Participant in the Survey must be current and accurate. The Participant is obliged to update this data. Changes to data provided in the paper Participant Survey must be sent electronically to KOCHAM WINO Customer Service at kochamwino@kochamwino.com.pl. If using the Application, the Participant should update the data using the Application’s functionalities. AMBRA is not responsible for consequences of failing to provide updated information.
3.9. Information regarding the Program may be communicated to the Participant electronically, including via email or phone number provided in the Participant Survey, or through the Application.
3.10. All actions taken using the Participant’s data are treated as actions of the Participant.
3.11. The Participant may consent to receiving commercial information through selected communication channels. Giving consent is voluntary and is not a condition for joining the Program. The Participant may withdraw consent at any time via the Application or by sending a message to kochamwino@kochamwino.com.pl.
4. Application and Winezja.pl
4.1. Within the Program, the Participant may use the Application, in particular to:
- use the virtual KOCHAM WINO Card;
- view the Point Balance;
- view information about the virtual KOCHAM WINO Card, including its type (color) and Card number;
- view information about transactions made within the Program;
- view information about special or additional promotional campaigns addressed to Program Participants.
4.2. Detailed rules for using the Application are available in the Application’s regulations. The Participant declares that they have read the Application regulations and raise no objections to them.
4.3. Through the Winezja.pl portal functionalities, the Participant may participate in the Program, in particular to:
- accumulate Points according to the rules described in the Regulations;
- declare the intention to use Points under the rules described in the Regulations;
- use the MAIN Discount assigned to the virtual KOCHAM WINO Card;
- (reserve products at reduced prices resulting from applying the MAIN Discount);
- view the Point Balance, including information on the number of Points accrued according to the Program Regulations;
- view information about the virtual KOCHAM WINO Card, including its type (color) and Card number;
- view information about transactions made within the Program;
- view information about special or additional promotional campaigns addressed to Program Participants.
4.4. Use of all Winezja.pl functionalities within the Program is possible provided that:
- the Participant is verified via a dedicated subpage in a domain belonging to AMBRA, to which the Participant is redirected from Winezja.pl portal or via the Application (if the Participant has an Account in the Application) using a dedicated button linking to the Winezja.pl portal from the Application;
- the Participant has an Account on the Winezja.pl portal (if no such Account exists, it can be created after verification, but no later than the expiration of the website session).
4.5. Verification is performed by providing current Participant data in the Program (phone number and email address) along with a verification code. If verification is carried out via the Application, no additional steps are required – verification occurs automatically. Upon successful verification, the AMBRA system provides the Participant’s data stored on the “Kocham Wino” Account to Winezja.pl, which will be assigned to the Participant’s Account on Winezja.pl (upon login) for the duration of participation in the Program. If the Participant is already logged into the Account at the time of verification, the data assignment occurs automatically (so-called “Account merging” procedure).
4.6. Detailed rules for using the Winezja.pl portal and services provided via the portal, including the ability to make free Product reservations (to enable concluding a sales agreement for Products in Stores) or create a Participant Account on the Winezja.pl portal, are specified in the Winezja.pl portal regulations. The Participant declares that they have read the Winezja.pl portal regulations and raise no objections to them.
5. KOCHAM WINO Cards
5.1. The KOCHAM WINO Card allows participation in the Program under the terms specified in the Regulations, including registration of Points accumulated by the Participant, Points Redemption, and use of MAIN Discounts.
5.2. The KOCHAM WINO Card remains the property of AMBRA. KOCHAM WINO Cards may not be sold or otherwise transferred to third parties. It is recommended to secure the KOCHAM WINO Card number against unauthorized access.
5.3. KOCHAM WINO Cards are not electronic payment instruments, and in particular, they are not credit, debit, or other payment cards.
5.4. In case of loss of the KOCHAM WINO Card or suspicion that an unauthorized person is using the Participant’s KOCHAM WINO Card number, the Participant should immediately contact KOCHAM WINO Customer Service via email at kochamwino@kochamwino.com.pl. AMBRA is responsible for damages resulting from failure or delay in providing this information only in the case of intentional fault or gross negligence by AMBRA.
5.5. Upon reporting the loss of the KOCHAM WINO Card or suspicion of unauthorized use of the Participant’s Card number, the Account and KOCHAM WINO Card will be blocked by AMBRA until the irregularity is resolved.
5.6. KOCHAM WINO Cards are issued in the following cases:
- BURGUNDY Card – upon registration in the Program according to the Regulations, in particular according to section 3.3 of the Regulations;
- SILVER Card – immediately after completing 6 Visits within 12 months (counted from the date of the first Visit). Failure to visit within two calendar years from the date of SILVER Card issuance will result in reverting to the BURGUNDY Card and associated benefits;
- GOLD Card – immediately after completing 6 Visits within 12 months and reaching a PARTICIPANT TURNOVER of PLN 10,000 gross. Failure to visit within one calendar year from the date of GOLD Card issuance will result in reverting to the SILVER Card and associated benefits.
For registration under section 3.2.1 of the Regulations, the Participant may receive a physical BURGUNDY Card; for registration under section 3.2.2, the Participant receives a virtual BURGUNDY Card. SILVER or GOLD Cards are issued in the same form (physical or virtual) as the BURGUNDY Card previously issued.
5.7. After downgrading from GOLD to SILVER, to return to GOLD the Participant must:
- achieve a PARTICIPANT TURNOVER of PLN 5,000 gross; and
- complete at least 6 Visits within 12 months (counted from the date of the first Visit after the Card color change).
5.8. After downgrading from SILVER to BURGUNDY, to return to SILVER the Participant must:
- complete at least 6 Visits within 12 months (counted from the date of the first Visit after the Card color change).
5.9. KOCHAM WINO Cards carry the following benefits for the Participant:
- BURGUNDY Card – MAIN Discount of 10% on wines and spirits offered within the Assortment, calculated based on Regular Prices;
- SILVER Card – MAIN Discount of 12% on wines and 10% on spirits offered within the Assortment, calculated based on Regular Prices;
- GOLD Card – MAIN Discount of 15% on wines and 10% on spirits offered within the Assortment, calculated based on Regular Prices.
5.10. The KOCHAM WINO Card, along with its associated benefits, is active from the moment of issuance in accordance with the Regulations for the entire time the Participant participates in the Program, or for the entire duration of the Program (whichever occurs first), except in cases where the KOCHAM WINO Card is blocked in accordance with the Regulations.
6. Earning Points for Purchasing Products
6.1. In connection with the purchase of Products, the Participant may earn Points using the SILVER Card or GOLD Card (or the numbers of the indicated KOCHAM WINO Cards). The Participant may not earn Points under the provisions of this section while holding a BURGUNDY Card (in case of a Product purchase, Points will not be assigned). Points are awarded according to the following formula (conversion rate): for every PLN 10 gross spent on a Product using the SILVER or GOLD Card, the Organizer grants 1 Point (i.e., 1 PLN gross = 0.1 Point). Points are granted for the purchase of products whose price has not been reduced as part of another promotion or special offer not described in this Regulation.
6.2. Points are credited in accordance with point 6.1 only in the following situations:
- Purchase of a Product at the “Centrum Wina, Distillers Limited” Store (including after making a prior reservation of the Product via the Winezja.pl portal);
- Purchase of a Product at a Partner Store (only after making a prior reservation of the Product via the Winezja.pl portal).
In case of a Product reservation via the Winezja.pl portal, Points will be credited only upon conclusion of the sales agreement in the Store. Points cannot be credited for the mere reservation of a Product via the Winezja.pl portal (without purchasing the previously reserved Product in the Store) or for non-fulfillment of an order made in another manner permitted by AMBRA. Within the Program, Points are also not granted for reservation handling services that can be ordered via the portal (website).
6.3. To accumulate (credit) Points, the Participant (Club Member) should:
- for in-store purchases, i.e., at the “Centrum Wina, Distillers Limited” Store or a Partner Store, present the SILVER or GOLD Card (physical or digital) to the Store employee at the beginning of the transaction;
- for purchases in the Store after a prior reservation via the Winezja.pl portal: at the moment of making the reservation, the person must be verified as a Participant according to points 4.4 and 4.5 of the Regulation, and then complete the purchase of the reserved Product in the Store.
6.4. After issuing a fiscal document or completing the payment process, entering the KOCHAM WINO Card number (SILVER or GOLD Card) and thereby crediting Points or using Points in the transaction is no longer possible.
6.5. The Organizer will not credit Points for a transaction in which the Participant uses Points.
6.6. For in-store purchases, i.e., while physically present in the Store, Club Member identification occurs when the SILVER or GOLD Card number is entered by the Store employee into the AMBRA system. In case of using the Product reservation option via the Winezja.pl portal, the Participant is identified (verified) according to the rules set out in section 4 (“Application and Winezja.pl”). The total number of Points accumulated on the “Kocham Wino” Account will be visible in the system to the Store employee and may be provided to the Participant upon request during the transaction or will be visible on the Participant’s Account in the Application the day after the transaction or on the Winezja.pl portal (provided the Participant has completed the verification process as described in the Regulation). In the absence of an online connection, the number of accumulated Points including the last transaction may be visible only after reconnecting to AMBRA’s central system. The seller has the right to ask additional questions to correctly identify the Participant. In case of activity via the Application or Participant Account on the Winezja.pl portal suggesting potential unauthorized use by a third party, AMBRA has the right to contact the Participant for verification and to block the KOCHAM WINO Card (SILVER or GOLD Card).
6.7. Points cannot be exchanged for cash or tangible rewards.
6.8. AMBRA reserves the right to adjust the number of Points credited to the Participant, including canceling part or all of the awarded Points in case they were granted due to conduct contrary to the Regulation. AMBRA will inform the Participant of the reason for the adjustment.
7. Earning Points for Successful Referrals of the Application
7.1. The Participant may earn Points for successfully referring the Application to persons who are not Participants and do not have a “Kocham Wino” Account.
7.2. In return for each successful referral of the Application, the Participant will receive 20 Points.
7.3. The Participant will receive Points for a successful referral if all the following conditions are met:
- The Participant provides a referral code (using the Application functionality) to a person who is not a Participant and does not have a “Kocham Wino” Account;
- The person who received the referral code downloads the Application, installs it on their device, and then joins the Program by completing the Participant Survey and entering the referral code in the designated field;
- The new Club Member purchases a Product at the “Centrum Wina, Distillers Limited” Store (including after prior reservation via the Winezja.pl portal) for a minimum value of PLN 30 gross.
7.4. Points for a successful referral will be credited to the Participant’s KOCHAM WINO Card number the day after the conditions described in this section are fulfilled.
8. Account Balance
8.1. Points credited to the Participant are recorded under the Participant’s KOCHAM WINO Card number in the AMBRA system. The current Point Balance can be checked via the KOCHAM WINO Customer Service, directly at the “Centrum Wina, Distillers Limited” Store, on the Participant’s Account in the Application, or on the Winezja.pl portal (provided the Participant has completed the verification process and logged into the Account on the Winezja.pl portal). AMBRA may also notify the Participant about their Point Balance via email or SMS.
8.2. Any objections regarding the accuracy or completeness of the Point Balance information received via SMS, email, during a Store visit, or displayed in the Application or Participant Account on the Winezja.pl portal must be submitted in writing to kochamwino@kochamwino.com.pl no later than 30 days from the date of receipt of the information. Relevant fiscal documents (e.g., receipts) must be attached to the objection. Failure to submit objections within this period is considered confirmation by the Participant of the Point Balance and no complaints will be accepted.
9. Using Points
9.1. Using Points consists of reducing the regular price of a selected product within the Assortment to a maximum of PLN 1.00 gross (as a one-time discount in a single purchase transaction) according to the following formula: 1 accumulated Point = PLN 1.00 gross discount.
9.2. To use Points, the Participant should present the KOCHAM WINO Card (physical or digital) to the Store employee and inform them of the intention to use Points. If the Participant does not have the Card, providing the Card number or presenting an identification document enabling identification is sufficient. In case of a reservation, the Participant can declare the intention to use Points via the Winezja.pl portal, which will occur at the moment of collection and payment for the selected product.
9.3. The discount on a product using Points is always applied by deducting the discount amount from the regular gross prices of the products not covered by the MAIN Discount or other promotions, including temporary price reductions.
9.4. The Participant cannot decide the number of Points to use in a single transaction. The maximum number of active Points reducing the price to PLN 1.00 will be deducted. Any remaining Points can be used later. A minimum of 0.01 Point may be deducted.
9.5. Points can only be used by the Participant. They cannot transfer the MAIN Discount, Points, or other rights to others, even if they are Participants.
9.6–9.7. AMBRA reserves the right to change the rules for earning or using Points, including conditions, number of Points per purchase or referral, type of eligible KOCHAM WINO Cards, and Assortment range, with 30 days’ notice via the Application or email. Changes do not affect Points already earned or used.
9.8. AMBRA also reserves the right to discontinue awarding Points under the current rules, with 60 days’ notice via email. Participants can still exchange unused Points for products until they expire.
9.9. Point exchanges will be confirmed on the receipt and recorded in the AMBRA system.
9.10. Participants cannot use Points or the KOCHAM WINO Card in ways contrary to the Regulation or applicable law. They may not transfer claims or pledge Points, Cards, or Accounts.
9.11. Points are used in the order they were earned (first-in, first-out).
9.12. Points are valid for one year from the date they are credited. After one year, they expire and are removed permanently. No claims against AMBRA arise from this.
9.13. Temporary unavailability of Point usage may occur due to offline connection, maintenance, or internal data processing.
10. Withdrawal from the Program
10.1. The Participant may withdraw from the Program at any time by:
a. Sending a letter to AMBRA (KOCHAM WINO Customer Service: AMBRA BRANDS sp. z o.o., ul. Puławska 336, 02-819 Warsaw, with the note: “Program Kocham Wino”) or email (kochamwino@kochamwino.com.pl);
b. In-person notification at the “Centrum Wina, Distillers Limited” Store or a Partner Store;
c. Deleting the Participant Account in the Application.
10.2. Withdrawal will be processed immediately, no later than 7 business days from the proper submission. From the moment of withdrawal, the Participant loses Club Member status and may not participate in the Program, including using the KOCHAM WINO Card, unless they rejoin. Upon rejoining, participation starts only from the rejoining date. Previously earned and unused Points before withdrawal will not be considered.
11. Complaints, Exchange, or Return of Products
11.1. Unless stated otherwise in the Terms and Conditions, any complaints regarding the Program may be submitted in writing (by sending the complaint to the Customer Service of KOCHAM WINO: AMBRA BRANDS sp. z o.o., ul. Puławska 336, 02−819 Warsaw, with the note: “Kocham Wino Program”) or by e-mail (sending the complaint to kochamwino@kochamwino.com.pl) during the Program as well as within 14 days from the end of the Program.
11.2. The complaint should include at least: the Participant’s full name, KOCHAM WINO Card number, and a detailed description and reason for the complaint. The complaint may also include the Participant’s e-mail if it is different from the one assigned to the Participant in connection with their participation in the Program.
11.3. AMBRA will review complaints based on the Terms and Conditions within 14 days of receipt.
11.4. The Participant will be notified of AMBRA’s decision regarding the complaint by registered letter or e-mail sent to the address indicated in the complaint within 14 days from the date the complaint is reviewed by AMBRA. If the Participant does not provide an alternative e-mail address, the decision will be sent to the e-mail address assigned to the Participant in connection with their participation in the Program.
11.5. Complaints regarding Products obtained through the use of Points may be made at the Store where the Participant received the product, within 30 days from the date of receiving the product. In the case of a justified complaint regarding products obtained through the use of Points, the Participant will receive a full-value product corresponding to the complained product within 14 days. If exchange according to the previous sentence is not possible for reasons beyond the Organizer’s control, the Participant may choose a product of the same regular price as the complained product. Points used in the transaction are not returned to the Account.
11.6. Complaints submitted after the deadline or without following the complaint procedure will not be considered.
11.7. In the event of a Product return, the Points accrued for that Product will be removed.
12. Termination of the Program
12.1. The Loyalty Program runs until further notice. In the event the Organizer decides to terminate the Program, the Participant will be informed at least 30 days before the planned termination. This information may also be communicated through the Application or via e-mail or SMS sent to the e-mail address or phone number provided in the Participant Survey.
12.2. When the Program is terminated, Participants will be able to exchange unused Points for products from the Assortment within the period specified in the notice of Program termination. After this period, the exchange of Points will no longer be possible; Points will be permanently blocked and removed, and Participants will not have the right to exchange them for cash or tangible rewards.
13. Final Provisions
13.1. AMBRA reserves the right to verify data and actions taken by Participants within the Program. If there is any doubt whether the Participant has met all the requirements set out in the Terms and Conditions, the Organizer has the right to withhold the accrual of Points, recognition of discounts, issuance of KOCHAM WINO Card, or Exchange of Points until the Participant demonstrates that they have met all the requirements specified in the Terms and Conditions. If it is found that the Participant has violated the Program rules, in particular provided false data or carried out actions entitling them to accrue Points in a manner inconsistent with the rules described in the Terms and Conditions, AMBRA has the right to exclude the Participant from the Program. Exclusion from the Program will mean that the Participant can no longer participate in the Program or use the KOCHAM WINO Card, as well as losing the benefits associated with the KOCHAM WINO Card. AMBRA will inform the Participant of the reason for the exclusion. The Participant may appeal the decision according to the procedure described in section 10 (“Complaints, Exchange, or Return of Products”).
13.2. The rules of the Program are defined exclusively by: the Terms and Conditions, the Application regulations (regarding the use of the Application, including user registration), the Winezja.pl portal regulations (regarding the use of the Winezja portal, including making reservations through Winezja.pl), and mandatory legal provisions. All promotional materials related to the Program are for informational purposes only.
13.3. Participation in the Program is voluntary. Taking part in the Program signifies acceptance of the Terms and Conditions.
13.4. The administrator of personal data processed for the purposes of the Program is the Organizer. Participants’ data will be processed solely for the purpose and to the extent necessary to run the Program. The full content of the personal data processing information clause is included in Appendix No. 3 to the Terms and Conditions.

Information on the processing of personal data
Data Controller
The data controller of Participants’ personal data, responsible for processing such data, is Ambra Brands sp. z o.o., headquartered in Warsaw, ul. Puławska 336, 02−819 Warsaw (hereinafter “Controller”).

Purpose and legal basis of processing
Participants’ personal data will be processed for the purpose of participating in the “KOCHAM WINO” loyalty Program, in particular to issue the KOCHAM WINO Card to the Participant, to grant the Participant certain benefits, including the MAIN Discount and Points, and to handle any complaints. Data may also be processed for the promotion, advertising, and marketing of the Controller’s products (goods and services) and brand. The legal basis for processing personal data is the legitimate interest of the data controller, namely marketing of its own products (goods and services) and brand, as well as the possibility of conducting the Program in accordance with the Terms and Conditions [Article 6(1)(f) GDPR].
Retention period
Participants’ data will be processed for the duration of participation in the “KOCHAM WINO” loyalty Program. After that time, the data will be processed only for the period and to the extent permitted by law, in particular until the expiration of the statute of limitations for the Participant’s claims against the Organizer.
Recipients of data
Participants’ data may be disclosed to other recipients, including IT service providers, courier and postal companies, Premium Service sp. z o.o., and Soare sekt a.s.
Rights of the data subject
You have the following rights regarding the processing of personal data: the right to access personal data, including receiving a copy of the data, the right to request correction of personal data, the right to request deletion of personal data, the right to request restriction of data processing, and the right to object to data processing. You also have the right to lodge a complaint with the supervisory authority responsible for data protection, i.e., the President of the Personal Data Protection Office. Information on the voluntary provision of data
Providing personal data for marketing purposes is voluntary. If the Participant does not consent to receiving marketing communications, it will not be possible to send information about offers of products (goods or services) that may be of interest to the Participant.
